1. About FundingScribe

FundingScribe is operated by FundingScribe Pty Ltd (“FundingScribe”, “we”, “us”, or “our”), a company registered in Australia. We provide an AI-powered grant writing platform designed to assist Australian non-profit organisations in preparing grant applications.

By registering for or using the FundingScribe platform, you (“User”, “you”, or “your”) agree to these Terms of Service (“Terms”) and our Privacy Policy.

2. Eligibility

To use FundingScribe, you must:

• Be at least 18 years of age
• Have the authority to enter into these Terms on behalf of your organisation
• Be using the platform for lawful purposes in connection with a registered or incorporated non-profit, charity, or eligible organisation
• Provide accurate and complete registration information

FundingScribe reserves the right to refuse access to any user or organisation at its sole discretion.

3. Accounts and Registration

To access most features of the platform, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account at support@fundingscribe.com.au

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or harmful behaviour.

4. Subscription Plans and Payments

FundingScribe offers the following plans:

• Starter (Free): Access to weekly grant match emails and basic eligibility overviews. No payment required.
• Apply ($99/application): Pay-per-application access to the full 5-stage workflow. Payment is due at the time of initiating each application.
• Growth ($249/month): Unlimited applications and full platform access. Billed monthly.
• Enterprise ($499/month): Multi-user, multi-organisation access with advanced features. Billed monthly.

All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable. Payments are processed securely via our third-party payment provider. We do not store your payment card details.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time via your account settings.

5. Refund Policy

We offer refunds in the following circumstances:

• Monthly subscriptions: If you cancel within 7 days of your initial subscription or renewal and have not used the platform during that period, you may request a full refund.
• Pay-per-application: Refunds are available if an application has not yet been initiated. Once the AI draft generation process has begun, refunds are not available.
• Technical issues: If a platform error prevents you from completing an application, we will issue a credit or refund at our discretion.

To request a refund, contact us at billing@fundingscribe.com.au within 14 days of the charge.

6. Use of the Platform

You agree to use FundingScribe only for lawful purposes and in accordance with these Terms. You must not:

• Upload content that is false, misleading, defamatory, or fraudulent
• Attempt to reverse-engineer, scrape, or copy any part of the platform
• Use the platform to submit grant applications containing deliberately false information
• Share your account credentials with unauthorised third parties
• Interfere with the security, integrity, or availability of the platform
• Use the platform for any purpose that violates applicable Australian law

Violation of these terms may result in immediate account suspension and, where appropriate, referral to relevant authorities.

7. AI-Generated Content and Accuracy

FundingScribe uses artificial intelligence to assist in drafting grant applications. You acknowledge and agree that:

• AI-generated content is a draft aid only and does not constitute professional legal, financial, or grant writing advice
• You are solely responsible for reviewing, verifying, and approving all content before submission to any funder
• FundingScribe does not guarantee that any application will be successful or that grant funds will be awarded
• You must ensure all submitted information is accurate, complete, and compliant with the relevant grant guidelines

FundingScribe accepts no liability for the outcome of any grant application submitted using the platform.

8. Intellectual Property

Your content: You retain full ownership of all documents, materials, and information you upload to FundingScribe. By uploading content, you grant us a limited, non-exclusive licence to process and use that content solely for the purpose of providing the service to you.

Our platform: All software, design, trademarks, and content comprising the FundingScribe platform are owned by or licensed to FundingScribe Pty Ltd. You may not reproduce, distribute, or create derivative works from any part of our platform without our written permission.

Generated drafts: Grant application drafts generated using your uploaded content and inputs are owned by you. FundingScribe retains no claim over the final content of your applications.

9. Confidentiality and Data

We treat all information you upload as confidential. Your data is stored exclusively in Australia (AWS ap-southeast-2) and is never sold to third parties. For full details on how we handle your data, please refer to our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by Australian law, FundingScribe shall not be liable for:

• Any indirect, incidental, special, or consequential loss or damage
• Loss of revenue, profits, or anticipated savings
• Loss of data or business opportunity
• Any damages arising from reliance on AI-generated content
• Failure to obtain grant funding for any reason

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the total amount paid by you to FundingScribe in the 3 months preceding the claim.

Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law, including consumer guarantees.

11. Indemnification

You agree to indemnify and hold harmless FundingScribe, its officers, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the platform, your breach of these Terms, or any content you submit through the platform.

12. Termination

You may terminate your account at any time by contacting us or using the account deletion option in your settings. Upon termination:

• Your access to the platform will cease immediately
• Your data will be deleted within 90 days in accordance with our Privacy Policy
• No refunds will be issued for unused subscription periods unless covered by our Refund Policy (Section 5)

We may terminate or suspend your account immediately if you breach these Terms, with or without notice.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before the changes take effect. Continued use of the platform after that date constitutes your acceptance of the updated Terms.

The current version of these Terms is always available at fundingscribe.com.au/terms.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
